The Employee Retention Credit, or ERC is a refundable tax credit paid back to qualified business owners as an incentive for keeping their employees on during the pandemic. The ERC was created by the CARES Act (Coronavirus Aid, Relief, and Economic Security Act) as a refundable credit that small business owners can claim on qualified wages paid to their employees.

This is a $400 Billion program, so there is no chance of the money running out. You just need to convince business owners to claim their file.

Do the Businesses Have to Pay the Money Back?

Absolutely not! Unlike the PPP (Payment Protection Plan), this is not a loan. It acts like a grant, which means it is free money for the businesses you refer.

Why Wouldn’t They Just Use Their Accountant?

Because it is extremely rare to find an accountant who is an expert in this area. These businesses need a specialist who is able to get them the maximum amount of money. What Businesses Qualify for ERC Tax Refund?

First off, the ERC is for small businesses, so don’t go looking for large companies. Besides that, there are two ways for businesses to qualify:

1. If the business was fully or partially shut down during the 2020 year after March 12, because of a government mandate. This includes ANY significant change the business had to make, including:

  • A business that ordinarily met with clients in person had to cancel meetings due to COVID-19.
  • A restaurant was forced to close and/or limit its on-site dining capacity due to COVID-19 restrictions.
  • Supply chain interruptions caused your business to have delayed production timelines.
  • COVID-19 restrictions lowered the amount of people who could attend an event with your business.
  • Your business had to reduce operating hours due to COVID-19 cleaning requirements and restrictions.

2. If you had a significant decline in gross receipts, you qualify. This will be compared to your 2019 sales, and a significant decline is a 50% decline in receipts compared to the same time period of the previous year.

How Much Money Can Businesses Make?

This depends, but in general, the total claimable amount per employee, across all 6 quarters that are eligible (quarters 2, 3 & 4 of 2020 & quarters 1, 2 & 3 of 2021), is $26,000 per W-2 employee.
